Within these core practice areas, Mr. Gray has particular experience representing end-use customers in litigation, in an advisory capacity, and with appeals of final agency actions. In litigation, Mr. Gray has advised clients in state court proceedings in New York and California. He recently served as outside counsel in an evidentiary hearing before the District of Columbia Public Service Commission regarding the reliability surcharge component of an electric distribution company’s retail rate filing. He has also tried multiple cases before Federal Energy Regulatory Commission (FERC) administrative law judges. In an advisory capacity, Mr. Gray serves clients with respect to rulemaking proceedings, legislative matters, compliance matters, wholesale and retail stakeholder processes, formal and informal settlement negotiations, policy issues, Regional Transmission Organization/Independent System Operator matters, and project development. In the appellate arena, he has assisted clients with appeals to the United States Court of Appeals for the District of Columbia Circuit and the Ninth Circuit.Prior to joining DWGP in 2008, Mr. Gray served as Assistant General Counsel and Litigation Counsel to the Kansas Corporation Commission (KCC). In wholesale energy/utility matters, his responsibilities included representing the KCC before FERC and advising the KCC’s representative to the Southwest Power Pool’s Regional State Committee. At the state level, Mr. Gray testified before, and prepared written testimony and analyses that were submitted to, the Kansas Legislature. In addition, he appeared on behalf of the KCC in various Kansas district courts, assisted with appeals to the Kansas Court of Appeals, and represented the KCC’s technical staff in a wide range of regulatory proceedings.
