Barry R. Horwitz

Barry Horwitz is a skilled intellectual property attorney with experience across all major areas of IP law, including patents, copyrights, trademarks, and trade secrets. Known for his strong litigation experience, Barry has represented clients in complex legal matters, handling everything from drafting pleadings and managing discovery to securing favorable motions, summary judgments, and trial outcomes. He played a key role in securing a seven-figure jury verdict in a high-stakes design patent, copyright, and trademark case, and has argued appeals before federal circuit courts. In his early years, Barry represented leading consumer electronics and mobile device manufacturers in patent litigation in multiple U.S. District Courts and before the International Trade Commission, but more recently his litigation experience has focused on trademark, trade dress, copyright and trade secret disputes.

His diverse experience outside of litigation includes managing patent, trademark, and copyright portfolios; handling trademark oppositions and cancellations before the Trademark Trial and Appeal Board at the U.S. Patent and Trademark Office; advising clients on the clearance and selection of trademarks; and prosecuting foreign and domestic patent, trademark, and copyright applications. Barry continues to prosecute patent applications in a variety of fields, and his brand management experience includes trademark, domain name, and copyright counseling and enforcement for clients in a wide array of industries.

Barry has also drafted and negotiated many types of intellectual property agreements, including sale and acquisition agreements, licenses, assignments, releases, and concurrent use and service agreements.
