About George A. Metzenthin
George A. Metzenthin has been practicing intellectual property law since 1996. He is a partner with the firm. Mr. Metzenthin works closely with his clients to help them identify their intellectual property and develop strategies to build and utilize their technology. Mr. Metzenthin provides clients with invalidity and non-infringement opinions as the need arises and is appropriate for the client goals and considerations.
Prior to joining Cahn & Samuels, LLP, Mr. Metzenthin worked in private practice in the areas of civil litigation and intellectual property. Mr. Metzenthin's practice encompasses all phases of intellectual property law including patent, trademark, copyright, and trade secret. He specializes in patent prosecution and licensing, with a particular emphasis in computer software, hardware, business methods and medical devices. Mr. Metzenthin regularly counsels clients regarding the global protection of their intellectual property and his familiarity with a wide variety of scientific and engineering disciplines enables him to understand, prepare and prosecute applications for his clients' innovations. Mr. Metzenthin has experience in all facets of patent prosecution before the USPTO including examination, appeal, ex parte reexamination, and interference proceedings. Mr. Metzenthin handles inventions in a variety of technologies including software, medical devices, and electrical/mechanical devices. He also has counseled clients on the use of design patent protection to further their goals. His patent prosecution knowledge includes preparation of ex parte reexamination requests and defending patents being reexamined. Based on this experience, he served as an expert witness regarding reexamination in Bortex Industry Co. Ltd. v. Fiber Optic Designs, Inc. (E.D. Pa. No. 2:12-cv-04228)(included a patent infringement claim). Early in his practice, he participated in interferences including strategy leading into the interference and the conduct of it.
Mr. Metzenthin has counseled numerous clients regarding the use of trademarks and copyrights to further their goals and protect their developed intellectual property. He has filed numerous trademark and copyright applications leading to issued registrations. He has counseled clients regarding the use of designs for trademarks and trade dress.
Mr. Metzenthin has over 15 years experiencing assisting U.S. Army medical laboratories product the fruits of their research through strategies that meet the concerns and goals for the resulting intellectual property. He has made a variety of presentations regarding these topics and the internal procedures of USAMRMC to military and civilian personnel at medical centers and military laboratories. In conjunction with the presentations on behalf of USAMRMC, he has assisted researchers and other personnel in identifying their inventions and prepared invention disclosures for those inventors. At times, he has the opportunity to provide counsel on the intellectual property rights of government contractors working individually or in conjunction with government employees. Mr. Metzenthin has developed knowledge about government software rights, technical data rights and Bayh-Dole Act obligations for contractors under funding agreements including contracts, grants, and CRADAs. Recently he finished a due diligence investigation encompassing all facets of intellectual property, technical data rights, and Government patent rights.
Mr. Metzenthin graduated cum laude from Case Western Reserve University with a Bachelor of Science in Electrical Engineering and Applied Physics with a minor in Economics. While an undergraduate, he was admitted to Tau Beta Pi. Mr. Metzenthin continued his educational endeavors by also attending law school at Case Western Reserve University.
