About Herman Max Leibowitz, Esq.
Herman Max Leibowitz is a New York City attorney with more than 35 years of experience in the fields of Wills, Trusts, and Estate Probate and Administration, as well as Estate Litigation. His areas of expertise include the drafting of wills, trusts, durable powers of attorney, living wills, and health care proxies. Mr. Leibowitz has extensive experience representing executors, trustees, heirs, and beneficiaries in the settlement of estates. He often does estate planning for individuals with disabled family members, so that they may receive the benefits of an inheritance without being disqualified from their governmental entitlements. Herman Max Leibowitz is certified by the New York State Supreme Court as an Article 81 Court Evaluator and Guardian. He also has a highly successful record of privately resolving family heirship disputes without court intervention. He is a dynamic public speaker on estate planning issues and procedures, often educating other attorneys at "continuing legal education" seminars in New York City and on Long Island. Representative speaking engagements include the New York City Bar Association, the Social Security Administration (Pre-Retirement Seminars for 14 years), National Business Institute (a nationwide legal seminar firm), Douglas Elliman Realty Company, Technion (the Israel Institute of Technology), and Volunteer Lawyers for the Arts. Representative publications include "Practical Advice for Representing Older Clients" (New York Law Journal) and contributor to "How to Use Trusts to Avoid Probate and Taxes" (Random House). Since 2008, Mr. Leibowitz has served each year on the panel of judges for the Yale Mock Trial Tournament in New Haven, CT, often serving as a Presiding Judge in this tournament. In June 2009, Mr. Leibowitz was the sole speaker in a national teleconference on the subject of "Maintaining an Ethical Balance in Probate Practice". In September 2010, Mr. Leibowitz was the sole speaker in a national teleconference on the subject of "Educating and Working with Personal Representatives in Estate Administration". This teleconference was also simulcast through West Legal Education Center as a web-cast. In June 2011, Mr. Leibowitz was the sole speaker in a national teleconference on the subject of "Marshalling and Managing the Estate Assets in Administration". At Rutgers University Law School, Herman Leibowitz was an Associate Editor of the Rutgers Law Journal, President of the Senior Class, and Commencement Day Speaker. Mr. Leibowitz is a member of the "Estates and Trusts" Section and "Elder Law" Section of the New York State Bar Association, and is a former member of the "Legal Problems of the Elderly" Committee and "Art and the Law" Committee of the New York City Bar Association. A highlight of Mr. Leibowitz's legal career was his successful oral argument and verdict, in January 2013, in the US Court of Appeals for the Second Circuit in a complex estate litigation.
