About Joe Kinlaw

Mr. Kinlaw’s real estate and land use practice includes representing buyers and sellers in a variety of matters, ranging from simple residential exchanges to complex multimillion dollar commercial transactions; preparation and review of deeds, easement and license agreements; land use analysis, zoning disputes, rezoning applications and variances; conditional use applications and special use applications, subdivisions, lot line adjustments, parcel reconfigurations and boundary line adjustments; and adverse possession and prescriptive easements. He has also successfully litigated easement disputes and zoning disputes. Notably, Joe represented the successful litigant in a complex challenge to the interpretation of El Paso County’s Special Use Permit process under the El Paso County Land Use Development Code in a published opinion of the Colorado Court of Appeals.

Joe’s general business practice includes business formation, administration, litigation, mergers and acquisitions. When forming a business, he encourages the founding members to constructively discuss and anticipate potential challenges in furtherance of developing an agreement that provides for resolution in the event conflict.

Joe has represented buyers and sellers in complex merger and acquisition transactions totaling over $50 million. Joe takes pride in being a “deal maker” and seeks out compromises necessary to preserve a transaction while remaining a steadfast advocate and advisor to his clients. Joe embodies the efficiency and technical aptitude necessary to bring deals to fruition in the high-speed, high-stakes world of complex M&A transactions.

Joe is experienced with drafting and reviewing complex commercial leases and litigating forcible entry and detainer (eviction) matters on behalf of individuals, trusts and estates.

When representing trustees and personal representatives, Mr. Kinlaw acts to ensure his clients fully understand their role as a fiduciary, while simultaneously providing counseling in more nuanced areas, such as fiduciaries’ interaction with creditors, beneficiaries and family members.

His probate practice includes representation of conservators, guardians, personal representatives and agents under powers of attorney, including challenges to judicial determination of incapacity and validity of wills.
