Kevin P. Blodgett

Kevin is an associate in the firm’s Litigation Department. His practice focuses on commercial litigation, creditor’s rights, and environmental law.

Kevin has experience representing businesses and individuals in civil and commercial litigation throughout the southeastern United States. He has also helped businesses in adversarial proceedings before the Florida Department of Administrative Hearings, including challenges to administrative rules and bid protests.

Prior to joining Smith Hulsey, Kevin represented private and public entities in civil and commercial lawsuits in state and federal court. These disputes involved business torts, contract enforcement, professional negligence, and catastrophic personal injuries.

Representative Matters

• Obtained a $43 million dollar judgment in a Tennessee bench trial against fiduciaries who misappropriated the funds and business opportunities of two biotechnology corporations

• Represented a lender and its agent in their foreclosure of 100 West Bay Street, the current Vystar building in downtown Jacksonville

• Obtained a dismissal with prejudice after disproving claims that a surveying company’s negligence resulted in the defective design of industrial plant equipment

• Represented governmental authorities in a construction defect action against professionals who built a 32-building housing project for Florida State University students

• Negotiated a favorable settlement after obtaining a partial summary judgment to preserve a beach access easement for the residents of a 93-lot subdivision

• Negotiated a dismissal with prejudice in which the plaintiff withdrew construction defect claims against a global engineering company
