About Nicholas R. Diamand
Nicholas Diamand is a partner in Lieff Cabraser’s New York office with a practice focused on domestic and international securities fraud, digital privacy, and consumer fraud cases.
Nick is currently working on derivative actions involving alleged misconduct at Fox Corp., Emergent Biosolutions, and Wells Fargo, and international securities matters on behalf of leading public and private funds against Danske, Glencore, Indivior, Barclays, Boohoo Group, and Petrofac. His past case work concerning securities and financial fraud includes litigation in the U.S. or internationally against Steinhoff, Facebook, AIG, Bank of New York Mellon, and Bank of America .
Nick represented the New York State Comptroller Thomas P. DiNapoli, as trustee of the New York State Common Retirement Fund, and the Fire and Police Pension Association of Colorado as Co-Lead Plaintiffs in a shareholder derivative action against The Boeing Company’s officers and directors . The action, alleging breach of fiduciary duty in connection with the board of directors’ oversight of the 737 MAX’s design and development, resulted in a 2022 settlement including a $237.5 million cash payment and extensive corporate governance reforms including a new board director, mandated director expertise, and an ombudsperson program.
He was actively involved in the Wells Fargo Shareholder Derivative Litigation in which Lieff Cabraser served as Court-appointed Co-Lead Plaintiffs’ Counsel; in April 2020, the Court granted final approval to a settlement including a $240 million cash payment and corporate governance reforms. The settlement represents the largest insurer-funded derivative settlement in history.
He acts or has acted in digital privacy litigation against Google, Facebook, LinkedIn, and Sony, as well as on behalf of children and their parents in data breach litigation against Disney, Viacom and other online game and app producers alleging violations of unlawful export, exploitation, and monetization of children’s personal information from mobile games without parental consent. Leading nonprofit advocates described these settlements as “the biggest change to the children’s app market,” impacting Defendants’ “business models” to prevent children from being “ targeted with the most insidious and manipulative forms of marketing .”
Nick is also working on consumer litigation against Volkswagen, and previously litigated against British Airways, as well as against the nation’s largest banks for their unfair and deceptive practices to maximize the occurrence of overdraft fees, and against oil companies for the recovery of gas royalty underpayment claims in which plaintiffs recovered more than $100 million in cash and future benefits.
