About Roger Martin

Roger Martin is a Partner in the Atlanta office with more than 35 years of active practice of law including all aspects of courtroom procedures and trials in the defense of medical negligence matters including birth trauma, long-term care, and professional negligence.

Roger is a part of the firm’s Medical Malpractice, Aging Services, Health Care, and Catastrophic Injury Litigation service areas. His wide-ranging experience in all phases of medical liability cases, in addition to first chair trial practice, give him unparalleled insight and expertise in achieving successful outcomes for clients.

He is often retained to attend and monitor trials of high-risk cases and to monitor and assess the exposures on these high-exposure cases as a result of his extensive experience in the courtroom in the psychological experience and evaluations of juries and jury trial determinations.

In addition to his trial work, Roger was appointed as a Commissioner for the state of Georgia to the National Conference of Commissioners of Uniform State Law from 1998 to 2014. He served as the legislative liaison for Georgia from 1998 to 2010, and he was instrumental in the enactment and passage of major legislation including Georgia’s medical records release law, Article 9 of the UCC, Article 7 of the UCC, The Uniform Fraudulent Transfer Act, and The Uniform Environmental Covenants Act. Based on his ample legislative experience, Roger was appointed to several drafting committees for the National Conference of Commissioners on Uniform State Law.

Earlier in his career, he was appointed as the Courtroom Administrator and Senior Law Clerk for a decade to the Honorable Judge Jack B. Smith, Senior Judge of the State Court of DeKalb County.

Roger is a graduate of the charter class of Georgia State University’s School of Law, completing his Juris Doctor in 1985. He also earned a Bachelor of Arts from Georgia State University in 1982.

Experience

Business Litigation

Roger brings extensive experience in dealing with both large and small business transactions. Prior to his work at Hall Booth Smith, Roger was corporate counsel for a major internet provider. He was involved in all aspects of corporate practice as Corporate Counsel. His experience includes the acquisition and purchase of several smaller entities as well as corporate reorganizations.

Roger also has extensive experience in the formation and operational aspects of his clients including the acquisition of physician practices, private placements, and asset purchase agreements. Roger brings a seasoned and experienced skillset with regard to all levels of business transactions envisioned in the busy corporate environment.

Health Care

Roger is an integral part of the HBS Health Care service group. He has extensive experience drafting and executing physician contracts, vendor agreements, policies and procedures, and operating agreements. He is well versed in HIPAA laws and regulations as well as EMTALA, anti-kickback laws, and the Stark laws.

Medical Malpractice

Roger has developed and maintains an extensive and diverse litigation practice. A majority of his litigation clients involve the defense of physicians and hospitals. Roger’s clients include CNA, AIG, St. Paul, Travelers, Zurich, and the Georgia Hospital Association. He has extensive experience in all aspects of birth trauma litigation including dystocia, CP, and fetal demise.
