Theodore J. Murphy, Appellate Attorney in West Chester, Pennsylvania

Ted Murphy launched his career in immigration law in 1994. While working as a sole practitioner he developed an expertise in handling detained and juvenile immigration matters before entering federal service in 1997. After serving more than a decade with U.S. Immigration and Customs Enforcement (ICE) and the former INS (Immigration and Naturalization Service), Mr. Murphy re-entered private practice in November 2007. He has handled countless notable matters in the Immigration and Federal Courts and is a frequent lecturer on immigration issues.

Mr. Murphy opened Murphy Law Firm in 2008 with a focus solely on the practice of immigration law. Mr. Murphy has extensive experience handling cases before the Immigration Court, the Board of Immigration Appeals, and the Circuit Courts. He is also admitted to the U.S. Supreme Court. The firm represents numerous clients both in removal proceedings and before U.S. Citizenship and Immigration Services.

As one of the government’s most experienced attorneys, Mr. Murphy represented the Agency in all matters before the Immigration Courts and Board of Immigration Appeals. He handled many types of criminal and national security cases as well as fraud and employer sanction cases. Having filed hundreds of appeals for the ICE Agency, he enjoyed a success rate of over 95% in those appeals. In 2003, Mr. Murphy was appointed as a Special Assistant U.S. Attorney. He assisted in the investigation and criminal prosecution of a large-scale, multi-state immigration fraud ring from January 2003 until August 2004.

In academia, Mr. Murphy served as an Adjunct Professor of Law at Temple University’s Beasley School of Law, where he taught both basic and advanced Immigration Law as well as International Organizations. Prior to his career in law, he served in the U.S. Army with various units including the 82nd Airborne Division. Early on, he worked for three years as a construction and land surveyor with a civil engineering firm in Chester County, PA.

Mr. Murphy received his undergraduate degree at Georgetown University (B.A., 1983) and his Law Degree (J.D., 1994) and Master of Laws (International Law) (LL.M., 1997) from Temple University. He is a member of several professional organizations including: American Immigration Lawyers Association (AILA); American Bar Association (ABA); Pennsylvania Bar Association (PBA); Chester County Bar Association (CCBA).

Represent U.S. Immigration and Customs Enforcement (ICE) in all matters before the Immigration Courts at detention facilities in York, PA, and White Deer, PA, as well as the Immigration Courts in various cities. These matters include: Removal, Deportation and Exclusion Proceedings; Asylum; Cancellation of Removal; Adjustment of Status; Rescissions; Derivative Citizenship Issues; Marriage Fraud; Visa Overstays; Visa Waiver Fraud; Administrative Removals; Credible Fear Reviews; Torture Convention Cases; and Employer Sanctions Cases.

Review, prepare and present cases at trial and on appeal. Filed more than 400 appeals with the Board of Immigration Appeals during the four year period assigned to York, PA — prevailing in over 90% of these appeals.

Represent ICE in meetings, at conferences and in other forums. Prepare legal advice, legal assistance and litigation support to the U.S. Attorney’s office and ICE operational units throughout Pennsylvania, Delaware and West Virginia. Frequently provide advice to the Examinations section of the former Immigration and Naturalization Service, now U.S. Citizenship and Immigration Services (CIS), in Philadelphia and Pittsburgh. Also provide advice to immigration inspectors at the Philadelphia and Pittsburgh Airports. National Security Law Division – Office of the Principal Legal Advisor. This division has a crucial role in the Department of Homeland Security efforts to protect the national security of the United States. Responsible for overseeing and coordinating nationally cases involving international terrorism, counter-terrorism, espionage and other threats to the national security. Provided legal, technical, and policy advice to the Principal Legal Advisor and Headquarters operational components regarding national security. Actively coordinated cases with other law enforcement, agencies, intelligence agencies, and the United States Attorney offices. Participated in the management of national security cases – overseeing the development of trial strategy and written work product in the field offices. Reviewed and drafted legislation, policy memoranda, and management directives as they pertained to national security. Developed an expertise in juvenile immigration cases. Instructed law students and attorneys on juvenile immigration law for the Philadelphia Volunteer Indigent Project. Successful challenges in State Courts resulted in the re-drafting of federal regulations governing custody of juvenile aliens.

Assisted Court management in reorganizing the Philadelphia Courts. Researched legal issues for the Executive Administrator. As a member of the Bench/Bar Counsel Fees Committee, assisted in designing and implementing a new system for appointment and payment of court-appointed attorneys for criminal and family courts. Assigned to personnel administration centers at Fort Bragg, North Carolina and Germany. Assisted in major streamlining of one battalion personnel administration center serving approximately 800 soldiers. Supervised programs for assignment of personnel, payroll and finance, promotions and awards, military education.

Nuclear, Biological and Chemical (NBC) Warfare Defense Supervisor

Responsible for training 1400 soldiers in all aspects of defense for nuclear, biological and chemical warfare. Completely reorganized and upgraded NBC capabilities for the 18th Airborne Corps’ 330th Movement Control Center.

First Master-of-Law in International Law from Temple University School of Law. Prior to the Fall semester of 1994, Temple University did not offer a Master-of-Laws (LLM) degree program in International Law. Proposed a course of study to the faculty during the 1993-94 school year for an LLM in International Law that was accepted as a solo pilot program. Course work was completed during the 1994-95 school year. Thesis was re-written during the following winter and completed early in the summer of 1996. It is now maintained in the rare book collection in the Law Library. Graduated with a 3.64 GPA, now recognized as “with distinction”. The solo pilot program was successful – the International (Transnational) Law LLM is regularly offered and has dozens of students each year.
