Representative Examples
• Prior to joining DH&D, Mr. Crammer represented an orthopedic surgeon in a case alleging that the surgeon negligently transected the posterior intraosseous nerve during a ruptured bicep tendon repair. A subsequent surgeon (who was not named in the case) discovered the rupture during an attempt to revise the biceps tendon repair and blamed our client. Utilizing EMG studies was able to convince plaintiffs expert that the nerve transection occurred during the revision surgery rather than the surgery performed by our client. Plaintiff’s expert withdrew from the case, plaintiff could not obtain a new expert, and we obtained summary judgment.
• Prior to joining DH&D, Mr. Crammer represented an infectious disease physician in a case involving an alleged failure to timely diagnose a spinal epidural abscess, which resulted in alleged nerve damage and ambulatory dysfunction. After careful review of plaintiff’s social media and arrest records, we utilized private investigators to obtain business surveillance footage of the plaintiff trying to steal a car and police bodycam footage of the plaintiff subsequently fighting with police. After disclosure of the surveillance, plaintiff settled with all parties for a nominal sum. All prior settlement demands had been for each defendants’ policy limits.
• Prior to joining DH&D, Mr. Crammer obtained summary judgment for a hospital on a claim that a consulting physician, who was not employed by the hospital, prescribed the incorrect medication, which caused significant and permanent cognitive injury to the plaintiff. Was able to elicit testimony during plaintiff’s wife during her deposition regarding plaintiff’s knowledge of the consulting physician’s employment status to serve as a basis for a summary judgment pursuant to the Cordero v. Christ Hospital decision. Despite strong opposition from the plaintiff, was able to prevail on our motion and obtained summary judgment for the client.
